(1) The Government of Nepal, in consultation with the Council of Justice, in any matter mentioned in the restrictive phrase of sub-section (1) of Article 132 of the Constitution of Nepal, shall appoint the Chief Justice or the Judge of the Supreme Court and in the restrictive phrase of sub-section (1) of Article 143 of the Constitution of Nepal. A High Court judge can be appointed in any of the mentioned cases and a district court judge can be appointed in any of the cases mentioned in the restrictive clause of clause (1) of Article 150. Such a commission may consist of a judge or other persons and if there is more than one member, the judge appointed by the government of Nepal or the provincial government will be the chairman of the commission. The government or the state government may constitute an inquiry commission with one or more members and in case of more than one member, the member appointed by the Nepal Government shall be the chairman of the commission. (2A) Notwithstanding anything contained in sub-section (2), the Nepal Government The provincial government cannot form an inquiry commission on matters that have already constituted an inquiry commission.
(3) The Government of Nepal shall publish the notice of the establishment of the Commission in the Nepal Gazette and the notice of the establishment of the Commission by the State Government shall be published in the State Gazette.
